This constitutional amendment bill raises the retirement age for judicial officers of superior courts of record from 65 to 70 years. Additionally, it establishes uniform provisions for their pension and related matters. The bill was signed by the president in accordance with the powers bestowed upon him by the 1999 Constitution as amended.
According to the bill, a judicial officer of higher courts of record includes individuals appointed to the Supreme Court, Court of Appeal, Federal High Court, National Industrial Court, High Court of Federal Capital Territory Abuja, High Court of a State, Sharia Court of Appeal of the Federal Capital Territory, Customary Court of Appeal of the Federal Capital Territory Abuja, Sharia Court of Appeal of a State, and Customary Court of Appeal of a State. Such officers can now retire at the age of 70, and their tenure will end once they reach the age of 70.
This particular amendment bill was among several constitutional alteration bills presented to the State Houses of Assembly for approval last year. However, it did not fall within the 35 bills that received the required approval of 24 out of the 36 state assemblies.
Additionally, President Tinubu expressed his administration’s commitment to strengthening the judiciary, upholding the rule of law, and empowering judicial officers to effectively carry out their responsibilities.
