At the time of the scandal, Hogan and Cole’s husband at the time (Bubba) were friends, but Cole testified that it was her husband who told him to sleep with Hogan! The filming of the tape occurred at Bubba’s house but they did not know that they were being filmed in his bedroom.
This led to Hogan suing Gawker for $100.0 million, but was awarded $140.0 million for the privacy violation! Rather than testify, Bubba invoked his Fifth Amendment rights and settled with Hogan in the amount of $5,000 for the sex tape.
Earlier, an expert who testified for Gawker said the site earned all of the $10,000 from the post that could potentially put it out of business.
Bubba’s attorney has said he will invoke the Fifth Amendment and not testify in the case. He and Hogan have reportedly settled a lawsuit stemming from the sex tape leak for $5,000.
Technology consultant Peter Horan said that since the ads were not running alongside the popular sex tape post, the profits were minimal.
