At issue was whether Allen’s $20 billion lawsuit should have survived beyond the oral argument simply by proving that in Comcast’s decision to deny distribution of its entertainment studio channels, its race was a “motivator” or if it was the only cause, also known as “but for” in legalese. The ruling was seen as having a potentially significant impact on future race discrimination cases.
The Ninth Circuit ruled in favor of Allen last year, but in closing arguments some judges criticized the lower court’s reasoning. The judges expressed clear skepticism about the release of a final decision setting a lower threshold in race discrimination cases when a case is first filed, and a higher threshold if it goes to trial.
Judge Neil Gorsuch, who delivered the opinion for the court, wrote: “Here a plaintiff has the burden of showing that race was a cause of his wrongful injury. And, while the evidence on which the plaintiff can rely to demonstrate causation may change as the trial progresses from filing to judgment, the burden itself remains constant. The opinion was posted online only, as judges postponed in-person proceedings out of concern over the spread of the coronavirus.
During oral argument, Erwin Chemerinsky, who argued for Allen, acknowledged that he was ultimately going to have to show that race was the sole cause of Comcast’s rejection. But he argued it would be an “insurmountable burden” to bear if plaintiffs had to prove this at the start of the case, as they would not have the benefit of depositions and discovery.
The case hinged on a section of the Civil Rights Act of 1866 that states that African Americans should have the same right to contracts as white people. A number of civil rights groups, including the NAACP Legal Defense & Education Fund, sided with Allen in the case, while the Justice Department supported Comcast’s position.
In a statement, Comcast said they “are pleased that the Supreme Court has unanimously restored certainty to the standard for bringing and proving civil rights claims. The well-established framework that has protected civil rights for decades continues. National civil rights laws did not change with this ruling; they remain the same as before the filing of the case.
They added, “We now hope the remand 9th Circuit agrees that the District Court correctly applied that standard in dismissing Mr. Allen’s case three times for not making a claim.” The company defended its diversity record and said “we will continue to look for ways to add even more innovative and diverse programming that appeals to our diverse audience and continue our diversity and inclusion efforts across the board.” the company.”
